1. Interpretation & Variation
1.1 Definitions
- Company: Yagoy BV.
- Member: Any person who has signed a Registration Form or checked the Waiver box online, which has been accepted by the Company.
- Practice Space: Any physical space in which Yagoy BV operates.
- Community: Includes Members, Teachers, and Recognized Representatives of Yagoy BV.
- Website: www.yagoy.nl, or affiliated websites.
- Terms & Conditions: As defined here.
1.2 Incorporation The Terms & Conditions are incorporated into the Registration Form and online booking system.
1.3 Variations The Company reserves the right to vary or revoke any of the Terms & Conditions from time to time as necessary for the regulation of the governance of the Practice Spaces and the conduct of Members. Any changes will be published on our websites and are binding until revoked.
1.4 Governing Law The Terms & Conditions shall be governed by the laws of The Netherlands and subject to the exclusive jurisdiction of the Dutch courts.
2. Membership
2.1 Becoming a Member When a person signs a Registration Form or ticks the terms & conditions online, they shall become a Member, subject to condition 2.2.
2.2 Acceptance Acceptance of a person as a Member is at the discretion of the Company.
2.3 Suspension or Termination The Company reserves the right to withdraw, suspend, or refuse to renew the membership of any Member whose conduct is, in the Company’s reasonable opinion, injurious to the character of the Company or amounts to a breach of the Terms & Conditions. Any expelled Member shall forfeit all membership privileges and is not entitled to any refund.
2.4 Promotional Offers Promotional introductory offers are exclusively for new students who are not already registered (Members) with the Studios and are not for repeat use.
3. Class Opening Times
Details of class times at the Studios may vary from time to time. Class times will be published by the Company on our Website. Studios are open 15 minutes before class.
4. Payment Terms
4.1 Pricing Details of class prices, class pass prices, and unlimited memberships are available on our website. Prices may increase from time to time to reflect increases in costs and benefits. Members will be notified of changes at least 60 days before price changes take effect.
4.2 Non-refundable Payments Subject to any statutory right of cancellation, payments for classes, class pass fees, and monthly subscription fees are non-refundable unless otherwise stated in the Terms & Conditions.
4.3 Workshops & Events Workshops and events at Yagoy are non-refundable. They can be credited to the account if notice is given at least 24 hours prior to the event date due to unforeseen circumstances (exceptions made for certain medical/personal circumstances at the Company’s discretion).
4.4 Gift Cards Gift cards can be redeemed for classes, memberships, or products. They cannot be redeemed for cash or cash equivalents.
4.5 Non-transferable Memberships All memberships (classes, class passes, and unlimited memberships) are non-transferable and may not be shared. Anyone caught sharing a membership will be denied entry and forfeit their membership permanently without compensation.
4.6 Unpaid Participation Members must settle any unpaid participation fees for classes, workshops, or other events at Yagoy. The Company reserves the right to suspend the member’s membership until unpaid participations are settled.
4.7 Negative Balances Members must settle any negative balance on their Yagoy account. The Company reserves the right to suspend the member’s membership until the negative balance is settled.
5. Reservation & Cancellation Policy
5.1 Cancellation Process Cancellations cannot be made via phone or email. All cancellations must be processed through our online booking system.
5.2 Early Cancellations For cancellations made more than 3 hours before the start of a class, no fee will be charged, and the class credit will remain in the member’s account. This allows waitlisted students to be contacted and join the class.
5.3 Late Cancellations, No-Shows, and Late Arrivals
- If a cancellation is made within 3 hours of the class start time, the class credit will be deducted from the member’s account.
- If a member fails to attend a class without cancelling or arrives after the class has started, the class credit will be deducted from the member’s account.
- For members with unlimited memberships, please refer to section 5.4.
5.4 Unlimited Memberships Members with unlimited monthly classes who cancel within 3 hours of the class start time or do not arrive for their reservation will incur the following fees:
- Late Cancellation Fee: A €6 fee will be charged to your account balance.
- No-Show Fee: An €8 fee will be charged to your account balance.
- Outstanding Fees: If there are two or more outstanding late fees on the account, or any late fees older than two weeks, the pass will be blocked until the fees are paid.
- Payment of Fees: Outstanding balances must be paid through the member’s profile at yagoy.nl or via the Yagoy app.
- Studio Payments: Late cancellation and no-show fees cannot be paid at the studio.
6. Personal Belongings
6.1 Liability Personal belongings are brought into the Studios at the Member’s risk. The Company does not accept liability for any loss or damage to such items. Members are advised to keep personal belongings with them and not leave them in the changing area or bathroom area.
6.2 Lockers Lockers are provided for small items in the studios. Items left in lockers at the end of the day will be placed in our lost & found, noted with the date, and disposed of if left unclaimed for 30 days. A €10 fee will be charged for a lost locker key.
7. Use of Facilities
7.1 Access A Member is entitled to use Yagoy’s facilities during scheduled class times, provided the Company may at any time withdraw all or part of its facilities for any period or periods with notice, where practicable, in connection with any cleaning, repair, alteration, or maintenance work or for reasons beyond the Company’s control.
7.2 Minors Children under the age of 16 may only attend classes if accompanied by an adult and under their care and supervision. The Company reserves the right to refuse access to any minor to practice according to clause 8.1.
8. Fitness & Health
8.1 Medical Advice Members are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. The Company reserves the right to refuse access to any Member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such facilities.
8.2 Health Conditions Members with conditions such as low/high blood pressure, cardiac irregularities, fever, cold, flu, or any suspected airborne infection should not attend class. Members should consult their doctor if in doubt. Members must notify the Company of any circumstances affecting their health which may be exacerbated through continued class participation.
8.3 Following Instructions Members are required to follow the instructions of the teacher at all times.
9. Dress & Footwear
Members are requested to wear clean, comfortable clothing appropriate for yoga practice. Footwear should be removed upon entry to the Studios and left in the entry area according to instructions.
10. Safety & Hygiene
10.1 No Smoking Smoking is not allowed anywhere on the premises.
10.2 Hygiene For the comfort of the Community, good hygiene is required. The use of unscented deodorant products is encouraged. Please refrain from using products with perfume or fragrance prior to practice.
10.3 Eating It is advised to eat no later than 2 hours before class.
10.4 Cleaning Props Members are requested to clean and put away any props provided by the Company for class after use.
10.5 Fire Safety In the event of a fire, Members are asked to make their way to the nearest available exit.
11. Non-Discrimination and Anti-Harassment
11.1 Commitment Yagoy BV is committed to an inclusive environment where all individuals are treated with respect and dignity. Each member of the Community has the right to work and practice in an atmosphere that promotes equal treatment and actively prohibits discriminatory behavior, including harassment.
11.2 Equal Treatment Yagoy ensures equal treatment without discrimination or harassment based on race, color, religion, sex, sexual orientation, gender identity or expression, age (over 16 years), disability, marital status, citizenship, national origin, genetic information, physical attributes, or any other characteristic protected by law. Yagoy prohibits any such discrimination or harassment by any member of the Community.
11.3 Reporting Yagoy encourages reporting of all perceived incidents of discrimination or harassment by any member of the Community to info@yagoy.nl.
12. Liability
12.1 Injury, Loss, or Damage Yagoy shall not be liable for any injury, loss, or damage in connection with, or resulting from, participation in classes or events.
12.2 Applicable Law and Dispute Resolution
- Governing Law: Dutch law exclusively applies to these Terms & Conditions.
- Complaints: If you have a complaint, please email info@yagoy.nl. If the issue cannot be resolved directly, the following certified mediation organization can be contacted to assess and mediate the issue: https://www.gecertificeerdemediators.nl/contact/ . Their final decision is binding and must be adhered to by both parties. The costs for mediation will be equally shared by both parties.
- Response Time: After submitting your complaint via email, you will receive a response within 10 working days. The complaint will be addressed and resolved within a maximum of 60 days from the initial contact. If the issue is not resolved within 60 days, an extension of another 60 days applies. If the resolution process takes longer than the initial 60 days, the student will be notified of the status, reasons for the delay, and a new estimated date of resolution.
- Privacy and Archiving: The complaint will be handled with care and protection of the complainant’s privacy. The complaint will be archived and retrievable for a period of 1 year from the initial contact.
12.3 Risk of Injury Yagoy only works with qualified yoga teachers and always offers yoga classes of the highest quality. Nonetheless, there is always a risk of injury involved when taking a yoga class. By participating in the classes or events, the Member accepts
