Terms and conditions

1. INTERPRETATION & VARIATION

1.1

In the Terms & Conditions the following definitions apply:

Company means Yagoy BV. Member means any person that has signed a Registration Form or checked the Waiver box online which has been accepted by the Company. Practice Space means any of the physical spaces in which Yagoy BV operates. Community includes Members, Teachers, and Recognized Representatives of Yagoy BV. Website means www.yagoy.nl, or affiliated websites. Terms & Conditions as defined here.

1.2

The Terms & Conditions are incorporated into the Registration Form & online booking system.

1.3

The Company reserves the right to vary or revoke any of the Terms & Conditions from time to time which it may consider necessary or suitable for the regulation of the governance of the Practice space(s) & the conduct of Members. Any such changes will be published on our websites &, until revoked, are binding on Members.

1.4

The Terms & Conditions shall be governed by the laws of The Netherlands & subject to the exclusive jurisdiction of the Dutch courts.

 

2. MEMBERSHIP

2.1

Subject to condition 2.2, when a person has signed a Registration Form or ticked the terms & conditions on-line, they shall become a Member.

2.2

Acceptance of a person as a Member is at the discretion of the Company.

2.3

The Company reserves the right to withdraw, suspend or refuse to renew the membership of any Member whose conduct is, or may deemed to be in the Company’s reasonable opinion, injurious to the character of the Company or amounts to a breach of the Terms & Conditions or where such expulsion is otherwise to be in the interests of the other Members. Any Member so expelled shall forfeit all privileges to membership & shall not be entitled to any refund for any period during which their membership is suspended.

2.4

The Company may run promotional introductory offers from time to time. These offers are exclusively for new students who are not already registered (Members) with the Studio(s) & are not for repeat use.

 

3. CLASS OPENING TIMES

Details of class times at the Studios(s) may vary from time to time. Class times will be published by the Company on our Website. Studios are open 15 minutes before class.

 

4. PAYMENT TERMS

4.1

Details of class prices, class pass prices, & unlimited memberships are available on our website. Prices may increase from time to time to reflect increases in costs and benefits. Increase in fees applies to new contracts and passes only.

4.2

Subject to any statutory right of cancellation, payments for classes, class pass fees, monthly subscription fees are made non-refundable unless otherwise stated in the Terms & Conditions.

4.4

Workshops & Events at Yagoy are non-refundable. They can be credited to account if notice is given with a minimum of 24 hours prior to the Event date due to unforeseen circumstances (exceptions made for certain medical/personal circumstances at the Company’s discretion).

4.5

Gift cards can be redeemed for classes, memberships, or products. They cannot be redeemed for cash or cash equivalent.

4.6

All memberships (classes, class passes, and unlimited memberships) are nontransferable and may not be shared. Anyone caught sharing a membership will be denied entry and forfeit their membership permanently without any compensation.

4.7

It is the responsibility of the member to settle any unpaid participation to a class, workshop, or other event at Yagoy. The Company reserves the right to suspend the member’s membership until the unpaid participations are settled.

4.8

It is the responsibility of the member to settle any negative balance on their Yagoy account. The Company reserves the right to suspend the member’s membership until the negative balance on the member’s Yagoy account is settled.

 

5. RESERVATION & CANCELATION POLICY

5.1

Cancellations will not be accepted via phone or email. All cancelations must be completed through the online booking system.

5.2

Early Cancels – In the case of cancelations more than 6 hours before the start of class no fee is applied, and the credit for the class remains in the member’s account. This allows waitlist students to be contacted & join the class.

5.3

Late Cancels / No Show / Late arrival – In the case of cancelations within 6 hours of the class start time, failure to attend a class without cancelation, or arriving after the starting time of the class, the class credit will be deducted from the member’s account. In the case of unlimited memberships, see section 5.4

5.4

Members with unlimited monthly classes –  At the third late cancellation or no-show within a calendar month, our system will apply the following measures:

  1. a €10 penalty fee will be charged from your payment method.
  2. if the penalty fee of €10 cannot be charged, the following measures will be applied:
  3. We reserve the right to cancel all your future scheduled classes.
  4. Your online booking privileges will be suspended as long as the fee has not

been paid.

  1. c. Your membership is still valid which means you can attend classes by registering only at

the desk 15 minutes before class if space is available.

 

6. PERSONAL BELONGINGS

6.1

Personal belongings are brought into the Studios at the Member’s risk & the Company does not accept liability for any loss or damage whatever to such items. For security reasons Members are advised to keep personal belongings with them & not leave them in the changing area/bathroom area.

6.2

Lockers are provided for small items in the studios. Items left in lockers at the end of the day will be placed in our lost & found, noted with the date, and disposed of if left unclaimed for 30 days. A €10 fee will be charged for lost locker key.

 

7. USE OF FACILITIES

7.1

A Member is entitled to use Yagoy’s facilities during scheduled class times providing always that the Company may at any time withdraw all or part of its facilities for any period or periods & with notice, where practicable, in connection with any leaning, repair, alteration or maintenance work or for reasons beyond the control of the Company.

7.2

Children under the age of 16 may only attend classes if accompanied by an adult & when under their care & supervision, however the Company reserves the right of refusal for any minor to practice according to clause 8.1

 

8. FITNESS & HEALTH

8.1

Members are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. The Company reserves the right to refuse access to any Member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such facilities.

8.2

Members with the following conditions should not attend class: low/high blood pressure & cardiac irregularities, fever, cold, flu, or any suspected airborne infection. If there is any doubt, the Member should consult their doctor. Members & their guests must notify the Company of any circumstances affecting their health which may be exacerbated through continued class participation.

8.3

Members are required to follow the instructions of the teacher at all times.

 

9. DRESS & FOOTWEAR

Members are requested to wear clean, comfortable clothing appropriate to the practice of Yoga. Footwear should be removed on entry to the Studio(s) & left in the entry area in accordance with instructions.

 

10. SAFETY & HYGIENE

10.1

Smoking is not allowed anywhere on the premises.

10.2

For the comfort of the Community, good hygiene is required. The use of unscented deodorant product is encouraged. Please refrain from using products with perfume or fragrance prior to practice.

10.3

It is advised to eat no later than 2 hours prior to class.

10.4

Members are requested to clean and put away any props provided by the Company for class after use.

10.5

In the event of a fire, Members are asked to make their way to the nearest available exit.

 

11. NON-DESCRIMINATION AND ANTI-HARASSMENT

11.1

Yagoy BV is committed to an inclusive environment in which all individuals are treated with respect and dignity. Each member of the Community has the right to work and practice in an atmosphere that promotes equal treatment and actively prohibits discriminatory behavior, including harassment.

11.2

It is the policy of Yagoy to ensure equal treatment without discrimination or harassment on the basis of race, color, religion, sex, sexual orientation, gender identity or expression, age (over 16 years), disability, marital status, citizenship, national origin, genetic information, physical attributes or any other characteristic protected by law. Yagoy prohibits any such discrimination or harassment by any member of the Community.

11.3

Yagoy encourages reporting of all perceived incidents of discrimination or harassment by any member of the Community to info@yagoy.nl.

 

12. LIABILITY

12.1

Yagoy shall not be liable for any injury, loss, or damages in connection with, or resulting from, participation in classes or events.

12.2

The Member will never engage the Company, the Teachers, or any Recognized Representative, in legal proceedings relating to possible damages in whatever form, that may be the result of participation in classes or events.

12.3

Yagoy only works with qualified yoga teachers and will always offer Yoga classes of the highest quality, nonetheless, there is always a risk of injury involved when taking a Yoga class. By participating in the classes or events the Member accepts such risk of injury. Yagoy offers the following guidelines to diminish the risk of injury:

 

Consult with a physician when you are not sure you are completely healthy, or have a condition, before starting to take yoga classes.

If you have an injury, or other physical issue, inform the yoga teacher before you start your Yoga class.

Listen to and follow the instructions of the Yoga teacher.

Be conservative in your practice and listen to your physical limitations.

Don’t do any exercises that are painful.

All Yagoy materials are under copyright protection of Yagoy BV and cannot be reproduced by the Student without permission of the author. Failure to comply may result in legal action.
